Focus: Recruitment Integrity & Swiss Law

1. Scope of Service

Omni Workforce Gateway provides a digital platform for job seekers and employers. We act as a private recruitment intermediary and maintain all necessary permits from the State Secretariat for Economic Affairs (SECO) and cantonal labor offices.

2. User Obligations

  • Candidates: You agree to provide truthful information. Misrepresentation of qualifications or work permit status is grounds for immediate account termination.
  • Employers: You agree to comply with Swiss Labor Law and the Federal Act on Gender Equality. You are responsible for verifying a candidate's final eligibility for a work permit.

3. \The Gateway\ & Matching

Our AI-driven matching service is an aid, not a final decision-maker. Omni Workforce Gateway is not a party to the eventual employment contract between the user and the employer.

4. Fees and Payments

  • Candidate access is free.
  • Employer fees are governed by separate Service Level Agreements (SLAs). All prices are in CHF and exclude VAT unless otherwise stated.

5. Intellectual Property

All platform content, including the \Omni Matching Algorithm,\ is the exclusive property of Omni Workforce Gateway AG.

6. Governing Law & Jurisdiction

These terms are governed by Swiss Substantive Law. The exclusive place of jurisdiction for all disputes shall be the courts of [Your Canton, e.g., Zurich], Switzerland.

Important Legal Notes for 2026

1. SECO Licensing

In Switzerland, if you are actively matching people to jobs (rather than just hosting a \passive\ bulletin board), you must obtain a license for private placement from SECO (State Secretariat for Economic Affairs).

Note: If you intend to place candidates from abroad into Switzerland, you need a cross-border placement license.

2. Stellenmeldepflicht (Job Registration)

As of 2026, the list of professions subject to the \Job Room\ notification requirement has expanded (covering over 10% of the workforce). Your Terms should mention that for certain roles, there is a mandatory 5-day \head start\ for registered Swiss job seekers before the role can be advertised or filled by others.

3. Privacy by Design

The nFADP requires \Privacy by Design.\ Ensure your developers have built-in \opt-in\ mechanisms for data sharing and that user data is automatically anonymized or deleted after the legal retention period ends.
